1. Introduction.

This Privacy Policy (“Policy”) explains how WELLNS LLC (“All In One Wellbeing,” “Health of Family,” “Financial Wellness Global,” “CARAVAN Wellness,” “CARAVAN,” “we,” “us”, or “our”) collects, uses, shares, and protects personal information about users (“you” or “your”) of our website (“Site”) and/or our application(s) (“App”) (where the Site and App are collectively referred to as “Service”). This Policy applies to WELLNS LLC and its subsidiaries and affiliates, to caravanwellness.com and its subdomains, and to any service that CARAVAN titles, describes, or authorizes as being “Powered by CARAVAN.” Please read this Policy together with our Terms of Use at https://caravanwellness.com/terms-of-use/. Appendix A (Cookie Notice) forms part of this Policy.

1.1. Acceptance and Changes.

By using the Service, you agree to the terms of this Policy. We may modify this Privacy Policy from time to time. We will post any modified version of our Privacy Policy at https://caravanwellness.com/privacy-policy/. If we change the Privacy Policy in a way that materially lessens our commitments to you, or in a way that involves a new purpose for using your personal information, we will provide notice to registered users by email or other methods.

2. Children’s Privacy.

We do not knowingly collect personal information from individuals who are under the minimum required ages specified herein. You must be at least 16 years old or the age of majority in your jurisdiction, whichever is greater, to use our services. Individuals under the applicable age may use our Services only with a parent or legal guardian’s involvement. If you are a parent or legal guardian who believes your child has provided personal information to us without your consent, you may ask us to delete such information by contacting us at [email protected].

3. What Information Do We Collect?

We collect information about you when you create an account, use our services, and communicate with us. Some of it you provide directly, some is collected automatically as you use the Service, and some may come from an organization that provides your access.

3.1. Account Information.

When you create an account, we collect your name, email address, and a password. If you choose to sign-up and/or authenticate using a third-party account (e.g., Facebook, Google), you authorize us to obtain account information from the third-party platform. You may also choose to give us a postal address, telephone number, username, date of birth, and gender, and you can set your communication and privacy preferences at any time. If you sign up through an employer, health provider, health plan, financial institution, or other organization, your account will also carry that organization’s affiliation and, in some cases, an employee or organization-assigned identifier.

3.2. Health Information.

We collect the health information you choose to provide. This may include your height, weight, self-reported health information, nutrition, fitness and training data such as calories burned, distance traveled, and heart rate, and the workout routines you follow. Providing this information is optional, but if you choose not to, some features or content may not be available to you. We limit who at CARAVAN can see this information. We do not use it for advertising, sell it, or share it for targeted advertising.

3.3. What You Access.

We collect which classes, videos, and content you access, and when. What you watch can reveal health information, so we treat these records the same way we treat the information described in Section 3.2.

3.4. Content You Submit

You may submit text, audio, images, video, and other content to the Service, and you may send us messages, support tickets, and other correspondence. We keep that content and our responses so that we can provide the Service and support you. If you participate in a live or recorded health and wellness session conducted over video conferencing, we collect the recording of that session and the associated participant information. You may authorize us to import information from a social network or another third-party service. We collect that information only when you expressly authorize the connection, and only what the connection covers.

3.5. Automatically Collected Information.

When you visit the Site or use the App, we automatically collect your IP address, browser type, operating system, mobile device type, mobile device identifier, and Internet Service Provider. We also collect information about how you use the Service — the pages and screens you view, referring and exit pages, clickstream data, and session timestamps. We collect some of this using cookies and similar technologies. Appendix A (Cookie Notice) explains what we use, and how you can control it. We draw limited inferences from the information above, and we use them only to operate and improve the Service.

3.6. Information from Enterprise Organizations.

If you access the Service through an employer, health provider, health plan, financial institution, or other organization, that organization may give us information about you. This may include your name, email address, and other contact details, your employee or organization-assigned identifier, eligibility and enrollment information, information about the benefits, programs, or content made available to you, demographic information, and other information that organization chooses to provide to us under our agreement with them. We use that information only as permitted by that agreement, and only for the purposes described in Section 4. This information comes to us from that organization’s records, and we cannot guarantee that it is current, accurate, or complete. If information we hold about you is wrong, you can ask us to correct it — see Section 12.

3.7. What Information Do We Not Collect?

  • Payment card and bank account information. Purchases are processed by a third-party payment processor, listed in Section 5.1. We do not collect, receive, or store your full payment card number or bank account details; that information is governed by the processor’s own privacy policy.
  • Government identification numbers. We do not collect Social Security numbers, passport numbers, or driver’s license numbers from users of the Service.
  • Biometric identifiers, genetic data, diagnoses, or clinical records generated by us. We do not perform diagnosis or treatment.
  • Information about children. Outlined in Section 2.

4. How We Use Your Data

We use the information we collect as follows:

  • Provide and maintain the Service, including creating and maintaining your account, delivering the content you request, and confirm it is you when you sign in (the legal basis for this processing is the performance of the user agreement between you and CARAVAN);
  • Respond to your inquiries and provide customer support (the legal basis for this processing is the performance of the user agreement between you and CARAVAN);
  • Operate and secure the Service, including monitoring availability and performance, detecting and preventing fraud, abuse and security incidents, and enforcing our Terms of Use (the legal basis for this processing is our legitimate interest in keeping the Service and its users safe);
  • Improve the Service, build new features, and produce and share trend reports and research. Where this involves health information or records of what you access, we use only de-identified information with all identifiers removed, never records that identify you (the legal basis for this processing is our legitimate interest in improving and developing our services);
  • Send you transactional and service messages, such as account notices, billing notices, and changes to this Policy (the legal basis for this processing is our legitimate interest in providing relevant information about the Service);
  • Send you marketing communications where you have opted in (the legal basis for this processing is your consent);
  • Market and advertise the Service, including managing our marketing campaigns, measuring how our advertising performs, and showing you CARAVAN ads on other websites and apps (the legal bases for this processing are our legitimate interest in promoting the Service, and your consent where we use cookies or share information with advertising partners to personalize ads);
  • Comply with the law, including tax, accounting and regulatory obligations, and to establish, exercise or defend legal claims (the legal basis for this processing is compliance with a legal obligation and our legitimate interest in defending our rights).

We collect health information and set non-essential cookies for the Service to work, on the basis of your consent. You can withdraw consent at any time by emailing [email protected]. Where we rely on a legitimate interest, you may object at any time. We use sensitive information only to provide the Service you requested, to keep it secure, and where the law requires it. We do not use it to infer characteristics about you.

5. With Whom We Share Your Data.

We disclose personal information only as described below.

5.1. Service Providers.

We share personal information with companies and contractors that perform services for us. These include commercial software providers, cloud hosting and storage providers, content delivery networks, video hosting and delivery providers, identity and single sign-on providers, content management providers, email distribution and marketing service providers, customer support and customer relationship management systems, video conferencing and event hosting providers, payment and billing processors, fraud detection and prevention services, security and monitoring providers, web and product analytics providers, analytics and advertising networks, remote access services, professional, legal, financial and compliance advisors, and other service providers. Service providers may have access to personal information depending on their role, and may use it only as our agreements with them permit.

5.2. Enterprise Accounts.

Some people reach CARAVAN through an employer, health provider, health plan, financial institution, or other organization that makes the Service available to them. Where we provide the Service on behalf of such an organization, that organization’s own privacy notice governs how your information is used, and your use of the Service is subject to that organization’s privacy policies, which may differ from ours. The organization, not CARAVAN, is responsible for the accounts it controls and for its use of its users’ data. We share information with that organization only as permitted by our agreement with them. We do not disclose to advertising partners any information relating to individuals who access the Service through a health plan, healthcare provider, or other organization on whose behalf we handle protected health information. If you want to exercise a privacy right over information we hold on behalf of your organization, contact that organization directly, or contact us at [email protected] and we will route your request to them. We may also disclose personal information to your organization at your request, in order to facilitate additional support for you.

5.3. Corporate Transactions.

If CARAVAN is involved in a merger, financing, acquisition, or sale of all or part of our business, personal information may be transferred as part of that transaction.

5.4. At Your Direction.

If you choose to post content to a social media or other third-party platform through the Service, that platform’s privacy policy governs the information you share with it.

5.5. Affiliated Companies.

We may share personal information with our affiliated companies, for the purposes described in this Policy.

6. Legal and Safety-Related Disclosures.

We may disclose personal information where we reasonably believe it is necessary to: comply with applicable law, a subpoena, court order, warrant, or other lawful request; enforce our Terms of Use; protect the rights, property, or safety of CARAVAN, our users, or the public; or cooperate with an investigation concerning public safety, as permitted by law.

7. Data Retention.

We retain personal information for no longer than is necessary for the purposes for which it is processed, unless applicable law requires us to store it for a longer period. When you close your account, we delete your information.

8. Communications from Us.

If you create an account, you may receive marketing emails from us. You can opt out at any time in your account settings or through the unsubscribe link at the bottom of each email. An opt-out request may take several days to process, and you will continue to receive transactional emails from us — for example, about your account, billing, or changes to this Policy.

9. Protecting Your Information.

We use physical, technical, and organizational security measures to safeguard your information from unauthorized or accidental disclosure. Despite these efforts, no information system can be 100% secure, so we cannot guarantee the absolute security of your information. You also have a role to play in keeping your information safe. We encourage you to use a unique and hard-to-guess password for your account and not to share it with others. If you believe someone has gained access to your account without your permission, please contact us at [email protected] immediately so that we can investigate.

10. Third-Party Services.

The Service may link to websites and services we do not operate. We are not responsible for their privacy practices. Review their privacy policies before providing them with personal information.

11. Location of Data and Data Processing.

CARAVAN Wellness is based in the United States, and we and our service providers process information there. As a result, your information may be processed in a country that does not provide the same level of data protection as your own. Where required by law, we provide adequate protection for transfers of personal information, such as by executing Standard Contractual Clauses. You may request a copy of these by emailing [email protected].

12. Your Privacy Rights.

You can update your account information at any time in your account settings or by emailing [email protected]. You can also opt out of marketing emails, limit the use of cookies, and close your account. Depending on where you live, you may have additional rights. These may include the right to know what information we hold about you, access it in a portable format, correct it, delete it, restrict or object to our use of it, withdraw consent, and opt out of the sale or sharing of your information or of targeted advertising (see Section 12.1). Where relevant, you may also have the right to limit our use of sensitive information and to opt out of profiling for decisions that produce legal or similarly significant effects. We process requests free of charge unless they would impose an unreasonable cost on us, and we may not be able to comply to the extent that a request would cause us to violate any law or infringe another person’s rights. If you are in the European Economic Area or the United Kingdom, you also have the right to lodge a complaint with your local supervisory authority.

12.1. Your Privacy Choices.

Our disclosure of certain internet activity and device information to third parties through cookies may be considered a “sale” or “sharing” of personal information, or processing for purposes of targeted advertising. You can opt out at any time by clicking the “Your Privacy Choices” button in the footer of our website, which opens our cookie banner and lets you change your preference. You can also set the Global Privacy Control (GPC) in each browser you use, and we will treat that signal as a valid opt-out request for that browser. If you visit us from a different device or browser, or clear your cookies, you will need to select your preferences again.

12.2. Additional California Disclosures

  • Categories collected in the last 12 months: identifiers; characteristics of protected classifications (age, gender); commercial information; internet or other electronic network activity information; geolocation data; audio, electronic, and visual information; professional or employment-related information; inferences. Sensitive personal information: health information, and account log-in in combination with credentials.
  • Categories disclosed for a business purpose in the last 12 months: all of the above, to the service provider categories described in Section 5.1, and to enterprise organizations as described in Section 5.2.
  • Categories we have “sold” or “shared” in the last 12 months: none. Going forward, we may share identifiers and internet or other electronic network activity information with advertising partners as described in Section 5.1, and we will update this disclosure when we do. We do not sell or share sensitive personal information, information relating to individuals who access the Service through a health plan, healthcare provider, or other organization on whose behalf we handle protected health information, or the personal information of any user we know to be under 16.

Appendix A — Cookie Policy

What is a cookie?

A cookie is a small file placed onto your device that enables CARAVAN features and functionality. For example, cookies enable us to identify your device, secure your access to CARAVAN, and even help us know if someone attempts to access your account from a different device.

When does CARAVAN place cookies?

We use cookies on our site. Cookies that are necessary for the site to work are set when you visit. If you are in the European Economic Area or the United Kingdom, we ask for your consent before setting any other cookie, and you can change your choice at any time using the cookie settings link on our site.

What types of cookies does CARAVAN use?

We use two types: persistent cookies and session cookies. A persistent cookie helps us recognize you as a user. These types of cookies can be used to make it easier to return to CARAVAN or interact with our services without signing in again. After you sign in, a persistent cookie stays in your browser and will be read by CARAVAN when you return to our site. Session cookies only last for as long as the session (usually the current visit to a website or a browser session).

CARAVAN utilizes both first and third-party cookies. First-party cookies are set by CARAVAN. Third-party cookies are set by companies other than CARAVAN, such as analytics and advertising providers.

Targeted Advertising

We do not allow advertising partners to receive health information or records of what you access.

However, if you limit the ability of websites to set cookies, you may worsen your overall user experience, since it will no longer be personalized to you. It may also stop you from saving customized settings like login information.
